Update: New Appeals process for Ethical Review
Thank you to those who took the time to participate in the consultation on the draft outline and terms of reference (TOR) for the new appeals process for ethical review.
The consultation document generated a high level of interest with over 20 separate formal submissions received from interested parties of the research and ethics communities. Overall, the feedback was positive and supportive. The submissions represented a wide range of views from individuals and organisations. Following this consultation phase, the responses were collated and reviewed at the last HRC Ethics Committee (HRCEC) meeting on 6th May 2009.
The HRCEC has decided to move forward by analysing and refining the proposed appeals process and TOR in light of the received submissions. The HRCEC will be preparing a revised final draft of the outline of the appeals process and TOR. The approved final documents will be made publicly available in the near future and will be distributed widely.

In 2004, the Ministry of Health announced a number of changes to the system of ethical review. One of these changes was the establishment of a right of appeal against the decisions of the Health and Disability Ethics Committees (HDECs). It has been proposed that the Health Research Council Ethics Committee (HRCEC) is the most appropriate body to establish an Appeals Committee
Dr Tim Dare, the Chair of the HRCEC, and the HRC Secretariat, under the direction of the HRCEC, have drafted Terms of Reference (TOR) and an appeals process for the Health Research Council Ethics Committee on Appeal (HRC ECA). The HRC ECA will have responsibility for hearing appeals on decisions made by ethics committees reviewing regional, national and multi-regional health and disability research and innovative practice occurring in New Zealand.
The HRC is seeking consultation on the draft TOR and appeals process. Feedback from any interested parties of the research and ethics communities would be appreciated.
